Democrats intend to use their incoming Senate majority to block Donald Trump from appointing a rightwing Supreme Court justice, Chuck Schumer said, according to [The Guardian](https://www.theguardian.com/us-news/2026/nov/06/trump-rightwing-supreme-court-justice). The party has secured 54 Senate seats, with two races still uncalled, while Republicans retain a six-week window in which they could potentially confirm a nominee.
Chuck Schumer says Democrats will reject a rightwing Supreme Court nominee from Donald Trump when they take control of the Senate in January, according to The Guardian.
“The bottom line is we’re not going to allow a rightwinger on the court,” Schumer said in an interview with the Associated Press, as reported by The Guardian. His pledge also covered lower courts and Trump’s cabinet: Democrats would not confirm “any crappy nominees”.
The incoming majority
Democrats regained both chambers of Congress in the midterm elections. They have secured 54 Senate seats for the next Congress and could reach 56 if their candidates win in Mississippi and Alaska. Both races remained uncalled, with Democrats leading.
As of Friday morning, Democrats were also set to hold at least 253 House seats after flipping more than 40, The Guardian reported. Schumer told the Associated Press he expected the party to have enough power to reject Trump’s nominees and halt other policies.
Thomas and Alito deny or give no indication of retirement
Four Supreme Court justices are in their 70s. Clarence Thomas, 78, and Samuel Alito, 76, are the oldest and the court’s two most conservative justices, according to The Guardian.
Republicans still have six weeks of Senate control during which they could potentially confirm a Trump appointee. Thomas has not indicated that he plans to retire. Alito denied retirement rumors and told Fox News on Thursday that he intended to remain on the court for the rest of the term, The Guardian reported.
Trump nominated Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett during his first term. Those appointments solidified the court’s 6-3 conservative majority.
Investigations and legislation
Some Democrats also plan to investigate Trump and members of his administration. Robert Garcia, the incoming House oversight committee chair, warned Republicans to “lawyer up” on Tuesday evening.
Democratic legislative priorities include restoring Medicaid cuts from Trump’s One Big Beautiful Bill and halting funding for the war in Iran, The Guardian reported. Trump has indicated that he plans to veto bills he disagrees with.
